A Description of the VideoEgg Ad Platform Online Program

VideoEgg operates an “ad network” that we call the VideoEgg Ad Platform Online Program (“the Program”). In running the Program, we have relationships with people who operate websites, webpages, blogs, applications (including interactive games), widgets and other experiences compatible with our ad serving experiences (our “Affliates” and their “Experiences”). Each Affiliate has agreed to let us display advertising in connection with their Experiences (our “Network”). VideoEgg also maintains business relationships with advertisers and their agencies (our “Advertisers”) who are interested in having their advertising distributed on our Network.

In order to operate and administer the Program and assist us in targeting of ads and the presentation of more relevant ads to viewers through the Program, we collect and use information about you as follows.

We know that some of the words and concepts used in this description may be difficult to understand. To help you, we’ve included a brief glossary of terms which can be accessed by clicking here.

Collection and Use of Personally Identifiable Information in the Program. VideoEgg collects, uses or stores personally identifiable information in connection with the Program as is described below.

Affiliate Registration. In order to become an Affiliate of the Program, you must register at our site by clicking [here] and be willing to enter into a business relationship with VideoEgg. During the affiliate registration process, you will be asked to provide registration information, such as your name, telephone number, e-mail address or telephone number about you and your business, such as your name, physical address, email address, other contact information, the company for which you work and the Experiences that you would like to have participate in the Program.

Your registration information: (i) is used by us to evaluate whether it is appropriate for you to participate in the Program; (ii) may be used by us or our providers to send you promotional information about the Program or other Services; and (iii) is used (to the extent you are accepted as an Affiliate) to establish your account, communicate with you regarding the Program, send payments to you and administer the Program.

Program.Except as provided below, VideoEgg and its providers do not collect, store or use personally identifiable information in connection with the Program.

Special Features. Sometimes when you view ads from our Network, we may provide you with special features such as “share an ad” or “movie times.” A full list of special features can be found by clicking here. In order to use certain of these special features, you may have to provide us with personally identifiable information such as an e-mail address.

Any personally identifiable information we collect through a special feature is used solely by us or our providers to complete your request and will only be kept as long is needed to provide you access to the special feature.

We will not associate any personally identifiable information provided by you through your use of special features with any other non-personally identifiable information we may have collected. We will not use any personally identifiable information provided by you through special features to provide advertisements about goods and services of interest to you.

On Behalf of our Advertisers. As described below, on the behalf of an Advertiser in connection with a specific campaign, we may collect personally identifiable information or non-personally identifiable information. Our use of any information gathered on the behalf of an Advertiser is subject to the privacy policies of such advertiser.

Collection and Use of Non-Personally Identifiable Information in the Program.

In connection with the Program, VideoEgg and its providers collect certain non-personally identifiable information, such as click-stream information, when you visit our Affiliates and view and interact with ads from our Advertisers. We use this information to administer our business, including determining when amounts are payable to or owed by our Affiliates and Advertisers. We also use this information to better provide you with advertisements for goods and services when you access the Experiences of Affiliates throughout our Network. An explanation of the information we collect and the technologies we use are provided below.

Cookies. VideoEgg uses “session”, “persistent” and “flash” cookies in connection with the Program. Our use of cookies in the Program is anonymous and does not allow us to gather personally identifiable information about you.

Web Beacons/Click-stream data. VideoEgg uses web beacons in conjunction with cookies collect click-stream data that we use for ad delivery and reporting purposes as well as to help us track how you interact with an ad displayed on our Network. As with cookies, our use of web beacons and click-stream data, is anonymous and does not allow us to gather personally identifiable information about you.

Passive Browser Information/Server Logs. In addition to cookie, web beacon information and click-stream data, VideoEgg and our providers collect passive browser information through its web servers and server logs when you are displayed an ad on our Network.

Non-Personally Identifiable Social Information. VideoEgg may use non-personally identifiable information provided to VideoEgg by our Affiliates. The non-personally identifiable information that may be provided by an Affiliate to VideoEgg may include your age, gender and your interests (“Non-Personally Identifiable Social Information”), but does not include personally identifiable information.

Opting Out of Non-Personally Identifiable Information.

If you do not want VideoEgg to gather non-personally identifiable information when you encounter and displayed in our Network, you can configure your browser’s settings to limit your acceptance of or delete cookies. Because the management of cookies in different browsers differ, you should consult the documentation of your browser in order to manage your cookies. In order to limit the acceptance of or disable “flash” cookies, you must access the management panel of the Adobe Flash Player installed on your computer. Note that if you limit or disable cookies, this does not mean that you will not be displayed ads from the Program. Instead, you will be displayed ads from the Program that are based on passive browser information or Non-Personal Social Information that may be provided by an Affiliate at the time you visit such Affiliate.

Affiliates & Advertisers.

Affiliates. When you visit an Affiliate’s Experience, please note that the privacy policies of those Affiliates will apply.

Advertisers. Ads displayed through the Program, may include opportunities for you to interact with the ad. Things you might be able to do within an ad include, playing a game, viewing pictures, watching video, requesting to be redirected to another website or submitting personally identifiable information about you. To the extent that you interact with an ad, provide information about you through an ad or are redirected to another website, the privacy policy applicable to that website, advertiser, its ad agency or their providers will apply.

At times in connection with a specific Advertiser’s campaign, an Advertiser will ask us to collect certain non-personally identifiable and sometimes personally identifiable information on the Advertiser’s behalf. If we collect and store such information, it will be for the benefit of the requesting Advertiser and we will abide by the privacy policy of the applicable Advertiser in our handling of such data. We will not associate any information (non-personally identifiable or personally identifiable) we collect for an Advertiser with any other information we may have collected about you through our Network.

Information Sharing.

In addition to VideoEgg’s general privacy policy, in connection with the Program, there are circumstances when we may share your information with third parties.

Non-personally identifiable information. In connection with the Program, we may share non-personally identifiable information with our subsidiaries, affiliated companies or other trusted businesses or persons for purposes of processing personally identifiable information or providing other services on our behalf.

Personally identifiable information. VideoEgg only shares personally identifiable information with other companies or individuals outside of VideoEgg as follows: (i) if VideoEgg has your consent for the sharing of personally identifiable information; (ii) to assist in the fulfillment of requests for services that you’ve requested from VideoEgg (for example, if you provide us e-mail addresses to use a special feature such as “Share an Ad”); or (iii) for data collection services provided by us to our Advertisers in connection with a specific Advertiser campaign. Note that any third party that VideoEgg chooses to share personally identifiable information will be required to enter into a confidentiality agreement with VideoEgg. VideoEgg may share your personally identifiable information to respond to subpoenas, court orders, or legal process, to establish or exercise our legal rights or, defend against legal claims and if in our judgment in such circumstances disclosure is required or appropriate. In addition, VideoEgg may share your personally identifiable information if we believe it is necessary in order to investigate, prevent, or take action regarding illegal activities, suspected fraud, situations involving potential threats to the physical safety of any person, violations of VideoEgg’s terms of use for our Services, or as otherwise required by law.

Information relating to children.
To become an Affiliate of the Program, you must be at least 18 years of age. If you are under the age of 18 and desire to become an Affiliate of the Program, we require you to certify that he or she has the consent of the parent or legal guardian of such person and to provide reasonable verification required by VideoEgg.

The Program is not structured to attract children under 13 years of age. The Program prohibits the use of the Program by anyone under 13 years of age, and require any person providing access to the Program to certify that he or she has the consent of the parent or legal guardian of such person and to provide reasonable verification required by VideoEgg.

VideoEgg does not knowingly collect or maintain personal information of anyone under 13 years of age in the Program, and if we discover that we have inadvertently collected such information, we will promptly delete it. Parents and legal guardians may request us to review, delete or stop the collection of personally identifiable information of their child by contacting us at the email or postal addresses listed below.

Modifications to these Policies. These policies policy may be modified by VideoEgg in its sole discretion at any time without prior notice to you. VideoEgg will post any revised privacy policy on this site and other places we deem appropriate. Your continued use of Services after the privacy policy has been modified and posted will signify your acceptance of such modifications for information provided by you.
